The company wants to use this one

They say they have no budget and can only give an author credit.

Should I do it to help out?

If its a Small company, why not.....it's not a UFO or Yeti footage....that your going to make a ton of money from.

I would donate footage for a non-profit or charity that was related to a cause I support. Don't give away valuable material to a for-profit enterprise. The guy who wants to get the footage from you expects to make money. He just doesn' want to give you any of it.

Didn't the originally approach you saying they were interested in purchasing???? If they don't have money to pay you, work out a trade that is of somevalue to you. maybe you get to go along, etc. IF that doesn't work, just say "no thanks".

Ideas from the peanut gallery...

If you give permission, do it on your terms:
- offer nonexclusive rights (that means you still own the videos and can allow others to use the videos)
-demand full onscreen credits to yourself for use of the videos
-perhaps negotiate some type of 'futures' payment...ie, if the show is a resounding success, goes into syndication, and reruns someday or whathaveyou that you get a tiny percentage of profit. Your bargaining power will likely be limited based on how long the footage is shown and how central it is the the theme of the episode.

This also comes to mind (EVH commenting on his solo for Beat It):
Van Halen recorded his guitar solo free of any charge. "I did it as a favor", the musician later said. "I was a complete fool, according to the rest of the band, our manager and everyone else. I was not used. I knew what I was doing – I don't do something unless I want to do it."

If they produce Wicked Tuna, perhaps they can swing you a tuna fishing adventure! That's what I'd ask for if they didn't have any money.

I learned a long time ago that if there is money to be made, don't expect the truth.

They aren't giving their work away, why should you?

I do give away photos if they are going to a non commercial entity, or if I know the entity has no budget, but I doubt very very much that any TV show producer or director has no money.
