Mandatory Breathalyzer
 
In the past 2 weeks I have had to provide a mandatory breathizer twice. What is going on? I don't drink at all or fit any kind of criminal profile. I feel like I should be able to say no especially with asthma and limited lung capacity. Is there some sort of a blitz going on?

I don’t know if it’s a blitz or just a long weekend thing. I had the same thing happen to me on Saturday and two of my friends yesterday. But I guess yours has spanned over a couple weeks 🤷*♀️ I think it’s surprising how many people will still get behind the wheel of a vehicle, quad etc while under the influence and the cops know it. Having said that, I side with you - super frustrating for those of us who have no reason to have to provide a breathilizer sample.

It’s automatic any time you get pulled over. It’s been a thing for like 2 yrs now.

You wouldn't be complaining if you had a friend or family member killed by an impaired driver.

TBH, sounds like something else is going on.. are they checkstops? Or were you pulled over? If you were pulled over then chances are you were driving erratically or someone reported you driving erratically at some point recently.

100% I'd be complaining. The police should have to be able to show through their video reasonable cause to demand a breathalyzer.

As much as I’m for getting impaired drivers off the road…… it’s an over reach.
What next? A simple jab blood sample to check for drugs?

Do tell. I got pulled over a couple weeks ago. No breathalyzer. Cop just wanted to remind me to renew my registration.

Plus the police can show up two hours after you have been reported at your house and demand you to blow. Could have had one drink at bar, reported by someone, 4 drinks at home . Face criminal charges, don't worry up to you to prove innocence.

But only for alcohol, smoke as much weed or other impairment drugs and its OK. They don't cause any accidents or deaths. We wouldn't want to infringe on people's rights for wake and bake. Be surprised how many vehicles I get to work on in the morning that smell of weed.

Want to go after impaired driving then don't pick and choose. Low hanging fruit as usual.

Last fall I was taking my Hwy Tractor into the shop to get repaired. My wife was fallowing me to pick me up to bring me home. The police had a checkstop setup at the Hwy junction. I had to get out of the truck to blow and my wife also had to blow. I was a little irritated that I had to do that but the officer informed me that they just caught an impaired guy 20 min earlier. This was at 9 am on a Monday morning. Guy was driving a company truck and was working.

Yes it’s an inconvenience but it is catching people.

get a letter from your lung doctor to say yiu may have trouble providing a breath sample with the limited lung capacity

also you should know that after the first try or two they know you are sober as the machine they now use tests for the presence of any alcohol and not just the blow over stat

Maybe you have a great personality. Myself, my wife and anyone I know that’s been pulled over it’s automatic. They made my wife blow with my grandma in the car.

Haven’t seen a Stop Check in years. Gotta be a better time than a Monday morning though. How about Friday evening from 12-3 am?

I'm waiting to hear about a Charter challenge, it violates your right not to undergo unreasonable search and seizure. I've heard of people sitting on park benches undergoing a demand for a breath sample.

I agree.. but that is not the way the law is currently written.

More than likely there is more to the story. But we'll never know.

As soon as a more non-invasive immediate way of detection is available it will be enacted.

I was not given a breathalyzer the 2 times I have been pulled over in the last 2 years. No suggestions of it either. I can’t think of anyone I know personally who has been in given the breathalyzer when they have been pulled over either

Maybe it’s the cops in your area I don’t know

DOT was at the Little Smoky rest area pulling in rigs and breathalyzing every driver. Way too much of an overreach.

The devil is in the details. Has this resulted in more charges being laid? DUI has been decreasing for years, has this law sped up the trendline?
