Well, that is an extreme point as you say.
but I'll take a run at it. If the child never touches the rod I would have to say that "they" are not fishing or catching a fish. They are watching you catch a fish very very close to them. I also doubt any F&W officer with a heart would ticket you, or judge convict you.
