It is called the "not withstanding clause". A province may use it if they lose a charter case. Quebec has already over language issues, Klien threatened to use it over gay marriage. Quebec knows they will lose a charter case over this issue and has already said they will invoke not with standing clause.

There isn't a lot that can be done
