The story behind this was posted a while ago. Glad to see he won his case. Unfortunately it is paid by the taxpayers, not those guilty of raping him.

Sounds like they should either retire that police dog, or take its signals with at least a bit of doubt.

If the dog signalled net to the officers own Mother, would she get the same treatment?

So I wonder what is happening to the officers, judge and doctors??? At the very least they should be losing their jobs/licences to practice, and I would think that criminal charges would not be out of line here.

Doubt any of that will happen though.

The western world is getting closer and closer to becoming a third world police state day by day it seems.

Don't blame the dog. It can be trained to give a false positive.

Not sure how the judge is liable in this case but the others for sure. Judge issued a search warrant based on information supplied by the police. Doctors were fine till they exceeded the parameters of the warrant.

Cops should be charged to the fullest extent of the law as should the doctors if they willingly exceeded the warrant.

In addition to the money, the victim should be allowed to return the favor to the doctors, and each police officer. The dog should be retired from duty.

Some of the medical staff were against the procedures too, but were pushed by the police to carry out the rape. It also appears that this may have been a racially motivated case, and was not isolated to Mr. Eckert, as there have been others who have been subjected to similar treatment. It also appears that the police and doctors violated the court order, as it did not grant them permission to perform anything other than a cavity search. And it also appears that the dog used was not qualified at the time, and was nothing more than a pet of one of the officers.

Civil rights attorney says Hispanic officers may have targeted 'white boy' because they 'don't like him living in their community'



"Maybe the officers who did this don't like him living in their community," said Kennedy. "He's a white boy, a scraggly white boy, and all these officers are Hispanic. It's a New Mexico thing."


In the search warrant affidavit that sought permission for an anal cavity probe, one police officer said he asked Eckert for permission to physically search him after the minor traffic stop. When Eckert refused, the document says, a police K-9 dog alerted them to the side of his car. Kennedy alleges the dog is not certified to search for drugs and may actually be a pet.

A judge granted the search warrant for the anal cavity probe, but not necessarily a colonoscopy.


Officers then transported Eckert to the Gila Regional Medical Center after an emergency room doctor at a Deming, N.M., hospital told them "this is unethical," Kennedy said. The doctor who refused to comply with police is willing to testify if the lawsuit goes to trial, according to Kennedy.

General population, where they can learn all about colonoscopies.
