Depending on the airline, you may be able to sky-check it (bring it with you to the gate, and they put it underneath then you get it back at the arrival gate) but my guess is that you'll be required to check it. Also heads up, if you sky check it/ carry on, you won't be able to bring liquids, gels or anything you typically can't bring through security in your pocket (knife etc.)
I am flying to one of the states in May and I have a 50L hiking backpack can I take it as a carry on or does it need to go below??

Carry on is limited to 21"x15"x9"
Your pack is roughly 26x15x12. Unless it's half empty and you can squeeze it into the sizing device... but I kinda doubt it.
