Default Gerald stanley firearms fines today

Got 3000 dollar fine plus 900 surcharge and a 10 year firearms ban today. Crown dropped the restricted (pistol) unsafe storage charge and he plead guilty to an unrestricted improper storage charge.

Is this charge conditional or discharge? Does it come with a criminal record?

Well, hopefully his wife or others in the household still have PAL's. One wouldn't want to advertise to the army of people who wish him harm that he's unarmed.

The fine is very reasonable but 10 years? That I do not agree with at all...

That seems to be vindictive, how many farm houses could the RCMP go to right now and find the same thing.

He forfeited some of his guns, $3000 fine, $900 surcharge, 10 weapons ban.

Because he was assessed penalty, it is neither conditional or discharged. He is guilty. He will have to pay $3900. It was not reported, but with this conviction, I believe he will have a criminal record.

Charge of improper storage of a restricted firearm was dismissed.


This was joint submissions from the Crown and defense council.

I have heard the Stanley's are trying to sell some of their land?

And when will the remaining FN boys be facing there charges? Oh ya I forgot they haven’t been charged with anything yet.. BS if you ask me..

So is this a normal type of charge for a improperly stored firearm? Seems very harsh to me. $100 fine should be adequate given all the circumstances.

How many times is this dead horse going to be beaten?

They received immunity for testimony. It’s not right, but it happened.

Max is six months in jail or $5000 fine for a summary offence. Considering he plead down two charges covering 7 NR and one R firearm, it would seem like much less than the maximum outcome

What testimony? All of them were looped! Huge mistake on the prosecutors office that's for sure.

C'mon Ken...if everyone did that there'd be about 3 posts a day. But this is as much a chat room as it is a forum and people ask questions.

they hand out 10 yr weapon bans on charges that arent even gun related... not sure ive ever seen a smaller sentence before.

I had a 10 year firearms ban for an assault causing bodily harm 25 years ago. No weapon. Just a fist to the nose. Broke his nose. It happens a lot.

All of the charges that were laid were firearm related and they are all criminal charges and all will be part of his criminal record.

I am surprised that Stanley's lawyer allowed him to make that deal. The crown had their day in court and the $3000.00 and 10 year ban just sounds vindictive.

Thats ridiculous. If your charge has nothing to do with a weapon why are we adding a weapons ban... and if we want to hand out weapons ban to every charge why is it a always 10 yrs.

Doesnt affect me but it does make you wonder what the goal of the govt is....

I was pretty shocked too.... and upset. Seems it’s always 10 year bans. Never heard of any other length.

It has to do with the perception that the guilty is a biolant offender and will Be for ten years no matter what

There have been lifetime bans.
But imho, there should have been a 10 day ban in this case.

I'm surprised his lawyer plead it out. Maybe Gerald is just tired of courtrooms & wasn't big into guns, just another tool around the place. Almost assured the guilty plea be cheaper, even with the fines.
