First Nations in Ontario sues to prevent TransCan from pipeline maintenance

The work will use heavy equipment to expose the buried natural gas pipeline in a 30 kilometre stretch, according to Raymond Ferris, who works with Aroland First Nation on land and resource issues.
"We feel that the [integrity digs]are being disguised as regular operations and maintenance but we believe this is part of an overall bigger project called Energy East," said Raymond Ferris.
Energy East is the proposed project that would convert TransCanada's natural gas pipeline to an oil pipeline, carrying Alberta oil to New Brunswick.
"This integrity work is for the ongoing maintenance and operation of our Canadian natural gas system and has nothing to do with our proposed Energy East Pipeline Project," said a spokesperson for TransCanada.
The company said two digs are planned for direct inspection, and another two digs are planned to run a pressure test on the pipeline. They were scheduled for January but have been delayed because of the injunction motion.

What interests me, is that a major concern for FN is consultation with their representatives regarding any new projects. Can some one please explain to me what exactly is the scope of work or consultation results that we will receive from FN on these projects, that we can not already acquire through historical values searchs, regulator environmental searchs, landowner interviews, wildlife surveys, etc?
Just trying to get educated on the consultation process and results....

Most Canadians agree with this aspect of our Apartheid system. Canadians generally agree a persons race should determine their level of political power. How they choose to use that political power isn't for other races to comment on.
Mostly because we might ask why those special racial rights to land and resources should extend beyond the Apartheid Zones that are reserves? Maybe the judge will explain that in his ruling?

EVERYTHING is someones Conspiracy Theory....the band should be fully aware of Energy East they've been involved in ongoing consultation for that specific project, if TC wanted to go in to do EE work, they'd simply say that.....
Was on site for a few "integrity digs" last year a hours east of Geraltdon, they dug a hole, and inspected the integrity of the lines.......

Yeah it is a squeeze for money, Maintenance and inspection is a requirement for the safety of all, where it has not been done or faked is in the books as huge disasters and spills the responsible company's are the ones trying to ensure safety to the public now.
Bad ones call bankruptcy and head to Bermuda...

It wouldn't be a "leak". It'd be a rapid excavation of a thousand cubic meters of right-of-way, followed by a several hour period of baking said excavation as well as setting fire to surrounding vegetation.

Sad to say, but in my opinion based on observation, FN consultation is legitimized extortion even here in Alberta and very rarely produces any meaningful result. When the activity levels in the patch dropped and all service providers cut left and right the invoices from FN's for consultation site visits doubled. When we inquired many FN's blatantly said that there is less money coming now so we have to increase each invoice. I couldn't care less if this approach was applied to reserve lands, IOGC oversees anyway and you take the risk of playing there, it's basically sovereign land. My concern is that FN's through their Treaty's claim a consultation right over all lands. Right now it's only administered on public lands, but the discussion always come up about private just no FN or Government wants to broach it because they know it's a powder keg issue which would polarize public against FN's.

Do we know which of the lines are being worked on? Simple answer to this question will indicate if this is assigned work to the energy east project. If I am not mistaken there are three pipelines,however only one has been identified to be converted to run oil.
