Bait ban...
Hi,
I went to Bullshead reservoir today. There is a bait ban for that lake. I usually fish with a little spinner on that lake.
Im just curious about the bait ban piece. I know I cannot use marshmallows, power baits, scents, bait fish or worms, on my line.
BUT, what if I have power baits in my tackle box...I mean in my possession, but not being used. Can I get in trouble, based on assumptions that I might use them? Shoudl I bring a tackle box with no power baits in it whatsoever? Leave the baits in the vehicle?
What is your experience?

I would say it depends on a, how the law is written and b, the game warden that runs into you. For example here in Montana just being next to a body of water with a fishing pole is prima facia evidence that you are/we’re fishing. That is how the law is written so even if your just carrying a pole from car to tent, if you don’t have a license you can get issued a citation. If that happens or not will depend upon the investigation conducted by the individual game warden.

From the Current 2018 regs. Leave the power bait at home.
Bait – an attractant or organism (alive or dead),
with scent or flavour intended to attract fish when attached to a hook or line used in angling. (See “Fishing with Bait” on page 25).
Bait – Bait includes, but is not restricted to: corn, cheese, marshmallows, meat, maggots, meal worms, earthworms, wax worms, gammarus shrimp, leeches, terrestrial insects, the larvae, pupae or adults of aquatic insects (e.g., stonefly, mayfly, caddis fly), bait fish, parts of fish, fish eggs, scented baits, power baits and all additives that scent or flavour artificial baits and lures.

If you don’t have it attached to your line, your fine. Been checked for bait before. They looked at the hook being used. Not in my tackle box. When barbless was in effect I was checked also. They didn’t go through my tackle box though. Just what was attached to my line.

Basically, you can’t get a fine for using bait, if you’re not in fact using bait. Lol

True, this is logical, although we all know that when you are out in the boonies and a peace officer starts to argue, you are somewhat dependant on their interpretation.
We seen this when some people using/transporting perfectly legal firearms but the officer doesn't know the ins/outs and seize wrongfully.

Many don’t know the law. They can charge you. That’s why courts decide, not officers. Up to you.

There is no charge for possession of bait. There is a charge for using bait.

It seems you already had the answer to the question you posted in your original post .
If you knew the answer why even waste time posting the question ?
It's real simple - leave the danged bait at home or in your car if you are going to a spot with a bait ban if you are worried about being hassled .

I was out last year and fish and wildlife stop by us asked for fishing license and took a look in our tackle box I had flavor marshmallows in mine he just asked if I was using it I said nope no bait in here he said ok make sure I don't and sat a cheated for a few more minutes then said have a good day nice guy but did give a ticket or anything

The only places in Alberta that I can think of for being ticketed for bait (or Lead) in your tackle box is the National Parks.
"When angling, it is unlawful to:
•Fish with or possess within 100 metres of park waters the following: ◦natural bait and chemical attractants;
◦any lead tackle (sinkers, jigs, lures and flies) under 50 grams;
◦lures with more than 2 gang hooks;
◦a line capable of catching more than one fish at one time. "

Hey guys, tried calling fish and wildlife but can’t get through. I just wanted to clarify, can I use soft plastics as long as They are un-scented?.

Yes soft plastics are ok if not scented. This one always worries me as I have some soft plastic grubs (different colours and sizwa) in a baggy in case I want to use them. They are in no in original bag so always worried that if I used them and questioned how would I prove unscented.
