I was rear end yesterday by a lady that was reportly impaired while heading south on the Anthony Henday between Baseline and Wye exits, I was cruising steady at about 100km/hr when she hit me, what a jolt.

ya he was so upset that he crashed that he immediately started drinking. didnt have a drink until he crashed.

I believe the RCMP have mathematical formulas for lots of their investigations including impaired driving, supported by their forensic labs and on-scene witnesses.

Time x height x weight x amount consumed x alcohol % x etc.....

I think this offender is in a heap of dutch.....Oh yeah, if guilty or not, add a hefty lawyer bill too.....

It’s pretty pathetic when one is practiced enough at drunk driving to not only know of such a stunt to pull afterwards but to have the booze on hand to do it. This is pre-planned!! On the other hand, being that it’s just a single beer and not a guzzle from a 26er of unknown initial volume they ought to be able to accurately calculate how much he had previously if they detain him for enough time.

By instantly guzzling booze after an accident like this, will make his blood alcohol level rise. They do 2 tests. If it is on the rise after the second test, it works in the impaired mans favour. As he could of been under the legal limit when accident occurred.

This thread immediately reminded me of the five people killed by a cement truck driver. Driver took a drink of vodka at the scene of the accident.

should have filled in the blanks. he was one of the gang of four that tazed Robert Dziekanski to death at the Vancouver Airport, and then months later turned left in front of motorcyclist Orion Hutchinson causing a head on collision (Hutchinson died of hie injuries at the scene). witnesses said he left the scene without any regard for the motorcyclist, and he later said he went home for a couple shots of booze. he was returning home from a halloween party with his children. now you know the rest of the story.

Drinking in public? Being intoxicated in public?

Could they not still charge him with being in care and control of a vehicle?

That's gonna be REALLY expensive and likely kiss his insurance goodbye.

Yep, I’ve responded to accidents where we had a good idea the driver was impaired. Unfortunately they made it to the bar across the street before we arrive and had chugged a few pints. Dui gone, maybe careless driving but that’s about all you got. No way to prove what his BAC was at the time of the crash and no witnesses so guy walks.

Knew a guy who kept a rum mickey bottle full of water in his vehicle at all times just for that reason. Claimed he once got off a DUI after he rolled his truck, said he got out sat down on the roadside, waited until another vehicle stopped then drank the whole thing in front of witnesses. He used water as he was usually already impaired but didn't want to be impaired to a level higher than what drinking a mickey real fast would make him by the time he got processed and breath tested, the results would be plausable with the claim of only drinking a mickey to calm his nerves after the crash. I don't know if this was true but that was his what he claimed and seem pretty proud of the fact. He eventually drank himself to death.

Bad idea. They do 2 tests 15 minutes apart. If they test him and the second test is lower than the first(blood alcohol level dropping) it’s a given that he didn’t just chugg 13 ounces......

This might be total BS info (and likely is) but someone told me that the guy in the video had just gotten out of prison (hence those weird sandals) for manslughter or something. Absolutely bizarro incident.

I think if they only have evidence of him drinking after the airbag went off then they can't charge him with care and control because the vehicle is undrivable.
