I know a trapper who shot a Grizzly thinking it was a Black Bear. The thing was as black as coal. Plus the bear was partially screened by willows.
He called F&W and they investigated. After seeing the bear and where it fell they decided to not press charges.
It's not as cut and dried as some seem to think. Animal identification, especially in a low clarity photo can be difficult even for those with many years of experience observing a particular species.
Distance, lighting, angle of the animal, lack of reference points, differences between individuals and obstructions can all make it a challenge even for the more experienced among us.
