Looks like an immature half grown sparrow that fell out of the nest.

This^. My first guess would be LeConte's Sparrow. I would assume it was in a damp grassy habitat? This bird has left the nest, but is probably still dependant on the parents from whom it was removed.

Yes he was in tall grass. My 9 year old step son almost hit him dirtbiking and brought him back to the house. Did some reading online and I guess they hop around for a bit while learning to fly but the parents still keep a close eye. We're bringing it back.
