I think it's a whole lot about nothing talk and they still need to work out a bunch of litigation and try ratifying something that makes sense without crossing the line of freedom of speech in consideration of censorship and/or regulation.

If this legislation is strictly about liability - it's unlikely to change much.

That's my perspective on it - hard to say until we see details instead of 20 minutes of really no substance.

I do agree there needs to be some accountability (not sure if this is the correct mechanism or who should regulate that) HOWEVER there's a very slippery slope and a fine line there.

What is at issue is referred to as the “26 words that made the internet”:

Now this has never been absolute, there are provisions where content like child pornography, copyright infringement and other things that would be illegal in a physical medium should also be removed by service providers. Some service providers choose to go a bit further, Reddit removing incel specific boards for example but others do not or rely on community moderation. On one hand this gives service providers some protection and flexibility but it has also landed them squarely in the middle of this new culture war unfolding in the US. Personally I was delighted when scumbags like Alex Jones and Gavin McInness got booted off of the major platforms in 2018 until I gave it some consideration. In my view both of them were absolutely using their positions on those platforms to incite hate and violence but making that call left the service providers open to a challenge on section 230 and now here we are.

This is the justification for today’s EO but it’s not the first swipe the Republicans have taken at it. They’ve been trying to pass legislation for a couple years, the Justice Department has been reviewing it and trying to make recommendations for months as well. Similarly there have been several calls from Democrats to increase the obligation on service providers to police hate speech more like our framework or the ones in Europe. Nobody is happy with the current balance.

However let’s not pretend this has been a well thought out compromise or something. Donnie got called out misrepresenting a concern as fact and he had himself a fit, I don’t think this is going to go well at all. Trump has called for expansion of US libel laws in a manner similar to what’s in the UK for years. He basically wants to legalize barratry so he can sue anyone who dares bring attention to his constant lying and misrepresentation. The inevitable result of which will place these companies in a position where they MUST censor their user’s content or open themselves up to an almost limitless liability that shareholders cannot abide. There could be grave consequences to this.

To add to it. Twitter has its own guidelines too which includes:

“We may suspend or terminate your account or cease providing you with all parts of the services at any time for any or no reason, including but not limited to, if we reasonably believe:
(ii) you create a risk or possible legal exposure for us”

They put a quick fact check instead of deleting his tweet to cover their butts at this point from a legal standpoint.

The real consequence to this all though is if Twitter/Facebook was to be shutdown due to legal exposure of everything they host it would crush the Republican Party as it was one of the main reasons they won in 2016. The 2020 election would be a very different beast without social media. This EO might just bite him in the keister.

It was Obama that showed the power of social media to get the underdog elected - swaying PO.

You make a good point however take a look at the net worth of these companies and people at the top who run these online platforms. They are in no way giving up such lucrative income.
They will either change the way they do things, conform to new rules, or cheat. One way or another they will still be there.

Agreed. No one in their right mind would leave that much money on the table, but if legal recourse is able to be implemented against the host for an individuals comments the amount of filters or disclaimers will essentially be the same thing probably.

US President Donald Trump said Friday that he may send in the National Guard in response to protests in Minnesota. "[W]hen the looting starts, the shooting starts," he tweeted.


Twitter flagged the tweet for promoting violence Trump's not going to be happy

What should be done with the looters? I'm not saying shoot them, but it seems that's their first action when they want to protest something

Lyndon Johnson ( a democrat, by the way) authorized the shooting of looters in 1967. And they did.

It seems like some 2nd Amendment type citizens have undertaken some defensive action, and rightly so by the photo’s I’m seeing from the area. I read this morning that 3 people were shot by citizens, but it was my assumption they were all defensive. I saw a photo of 4 fellows armed with AR-15’s putting up a perimeter while guarding a business, good for them! If someone wants to claim you can’t do anything with an AR-15, I’ll have to bring that image up, now to go find it again so I can save it.


It’s not sunny like with the well known ‘rooftop Koreans’ image from the LA riots, but its got diversity and shows people working together for good, preventing bad.
