Default Any advice guys

I recently got into a car accident. It wasnt my fault he rear ended me. Anyways his insurance is no calling me and they want to talk about the accident. Is there anything i should look out for. Any jedi mind games they will try to play with me.

Don't sign off on anything,sometimes it's good to wait and make sure no pains or headache develops.

get a lawyer, let your insurance and lawyer take care of everything, you have no reason to talk to them.

As mentioned - don't sign off on anything, DO NOT say anything - good bad or otherwise. What you may think is an innocent statement will be construed in an unfavorable way. Problems may develop later. They should not even have contacted you. Let them deal with the insurance. Don't bother with a lawyer unless you have a lot of money you want to throw away.

Tell them to deal with your insurance. No reason for them to deal directly with you.

X2! They should NOT be calling you. Next time they call, direct them to your insurance company and let them know that you will not discuss the case with them.

I agree but if both parties happen to be covered by the same insurance company this changes the way they handle the case. No matter what, they are paying out due to covering both drivers. A guy at my work got rear ended by Semi while trying to make a left turn off a hi way a couple years back.... what a gong show trying to settle due to both of them being insured by the same company

been there, done that..

basically the guys insuranse company told me my car was't worth much and neither was my stereo which was being transported in the car. They also said that there was the matter of if the traffic lights were operating properly at the time of the accident....perhaps his client didn't run a redlight..maybe there was some other issue..with the lights.

All in all they said that they were looking out for their client, but recognized I needed to be compensated. They were my buddies too.

The proposed $1500...I said let me think about it,..they said I had one hour, it was on the table right there and then,..and was more than reasonable.

In that hour I called my buddy who is a lawyer,...

I didn't get $1500 that day,..but 2 years later I got a cheque that saw me buy a brande new car, new computer, pay my tuition for the year, etc etc etc...

DO NOT TALK TO THEM!

Call a lawyer,...most accident lawyers only collect if you collect.

Unless you have severe injuries,you will not get much from them. Good old PC's capped your injuries at $4000 for all minor injuries. You won't get a decent lawyer who will help for 1/3 of that.

Tell them to contact your insurence claim person and tell them not to call you again and that they can get any answers they need through your agent.

You think this is morally correct tho? If I ruin your car you should not get a penny more then what that car is worth.

Girl at work got her car totalled and now has constant numbness in her hand and only got $4k out of it due to the cap and it being a "minor injury"

I don't know about you but 4K doesn't come near covering having numbness for the rest of your life in your hand. Or atleast for the last few months.

IMO it depends. If you're not hurt, don't drag it out. Just get your car repairs paid for in full and maybe a little extra for the inconvenience.

But if you're honestly hurt, don't talk to them. Go to the doctor, do whatever he/she recommends and keep records of EVERYTHING. Follow through on all physio etc.

Have your insurance company fight it out for you if it wasnt your fault they should go to bat for you. If that doesnt work well Lawyer up. Make sure the other persons insurance company doesnt bully you into getting estimates for the damages or sending you to one of their "approved" shops. Both will just waste your time and energy. And dont sign anything until your satisfied. They cant tell you that you have an hour to agree with their offer or anything like that so tell them to pound sand and do it on your own time. Remember it can take a couple days if not weeks for any symptoms of pain from the accident to show up.

Keep a day to day Diary on your aches and pains..How limited you are at work at home at play In other words everything up til the day you either go to court or setlle.Believe me it is well worth the effort...You may give a copy to them but not the original as it may disapear

As a former Safety and Compliance Officer for a major trucking company, my advice to you is to not have any further contact with the other parties insurance. Their job is to attempt to create reasonable cause to not pay out the claim. To do this they will talk to you on the phone and try to sound like they are your new best friend. They will tell you that they just want to resolve this incident in a timely manner for both parties. You will be asked innocent sounding questions and slowly be lead down a path where you will be asked questions that will create the illusion that you may have been even partially responsible. Once you have assisted them in creating reasonable doubt (without even realizing it), they will thank you and tell you that everything will be cleared up shortly. However, what you will find is that suddenly the claim seems to drag. Your insurance company contacts them and they either refuse to talk for a fairly long period of time, or they will blatently tell your insurance company that they are prepared to fight the claim in court based on new evidence. So the thing for you to do today is, contact your insurance agent immediately and tell him what is going on. Advise them that you are not prepared to talk at any point in time to the other parties insurance adjuster. You are not required by law to provide any conversation to the other parties insurance company unless you are asked to do so in a court of law at which point you will have your lawyer and a member of your insurance company present.
